 Resumo: A partir do aspecto contraditório da moral freudiana – segundo o qual a lei interna se apresenta como cindida em seu aspecto pulsional, de um lado, e censor, de outro –, pretendemos ampliar o que seriam as caracterizações dessa moralidade em seus questionamentos filosófico e jurídico. Para tanto, trataremos da opacidade em torno da obediência e transgressão à lei, que nos aparece como categórica, excessiva e arbitrária, já que é paradoxal em seu conteúdo. Nesse seguimento, ao questionarmos sobre o delineamento do que é propriamente individual na formação moral do sujeito, chegamos à conclusão que na moral freudiana não pode haver uma distinção entre autonomia e heteronímia conforme as definições modernas do sujeito em relação ao social. Contudo, ainda podemos falar de um limite de identificação no processo de socialização dos indivíduos que os faz dotados de diversas relações à lei. É tal relação que figuramos com a situação analítica da “reação terapêutica negativa”, como exibição de um modo de confronto com a lei que se encontra na fronteira da regra jurídica da hiper-moralidade, exemplificação de momentos em que os sujeitos torcem o sentido da regra moral.

Abstract:Starting from the contradictory aspect of freudian moral – whereby the inner law is presented as being divided in instincts, on one hand, and censor, on another hand – we intend to extend what would be the characterizations of that morality in its philosophical and legal questions. We will deal with the opacity surrounding the transgression and the obedience to the law, which appears to us as categorical, excessive and arbitrary, since it is paradoxical in its contend. Following this, we question about the delineation of what it is properly individual on subjective moral formation, and we conclude that, in the freudian moral there must be no distinction between autonomy and heteronomy as the modern definitions of the subject in relation to social. However, we can still talk about a limit in identifying the process of individual‟s socialization that makes them endowed with different links to the law. We figured that relation with the analytic situation of „negative therapeuthic reaction‟ as a manifestation of the confrontation the law that is on the border of the legal rule of hyper-morality, example of moments when the subjects twist their sense of moral rule.
