Resumo: Este estudo trata da distinção e da relação entre direito e moral no pensamento do filósofo e sociólogo alemão Jurgen Habermas buscando mostrar como se desenvolvem as linhas gerais da distinção e da relação entre direito e  moral na obra Facticidade e validade e como a distinção e relação assim traçada na esfera doméstica possui reverberações na esfera internacional, particularmente na conceitualização dos direitos humanos como direitos morais e jurídicos ao  mesmo tempo e que essa compreensão dos direitos humanos, juntamente com um conjunto de reformas propostas na esfera internacional no debate que Habermas empreende com o projeto de Kant em À paz perpétua, fornece recursos para responder às críticas realistas aos direitos humanos, que interpretam os direitos humanos como estratégias de redução do status dos adversários na geopolítica internacional e com isso instrumentos para dar liberdade à violência sem limites contra o pretenso inimigo injusto.

Abstract: This study deals with the distinction and relationship between law and morality in the thought of the German philosopher and sociologist Jurgen Habermas, seeking to show what are the main aspects of the distinction and the relationship between law and morality such as They are developed in the work Facts and Norms and how the distinction and relationship thus traced in the domestic sphere has reverberations in the international sphere, particularly in the conceptualization of human rights as moral and legal rights at the same time and that this understanding of human rights, together with a set of reforms proposed in the international sphere in the debate that Habermas undertakes with the project of Kant in Towards Perpetual Peace, provides resources to respond to realistic criticisms of human rights, which interpret human rights as strategies to reduce the status of opponents in international geopolitics and thus instruments to give freedom to unlimited violence against the alleged unjust enemy.
