Resumo: Partindo da relação entre estado, direito e poder tal como é pressuposta na teoria jurídica, o texto investiga as transformações no mundo contemporâneo que vêm afetando o direito e colocando em xeque tal correlação. Contrapondo a noção tradicional de poder à narrativa de Hannah Arendt, procura compreender como a experiência política presente traz, com o irrefreado encolhimento da esfera pública, a ubiquidade da violência.

Abstract: Taking into account the relation between state, law and power as it is presupposed in juridical theory, the text investigates the transformations in the contemporary world that have been affecting the Law, putting in check such correlation. Contrasting the traditional notion of power with the narrative of Hannah Arendt, it seeks to understand how the present political experience promotes, due to the unrestrained shrinkage of the public sphere, the ubiquity of violence.
